This document sets out the legally binding terms governing the use of the website bgcars.ge and the services offered through it. It is prepared in accordance with the Civil Code of Georgia, the Law of Georgia on Consumer Rights Protection (2022), and the Law of Georgia on Electronic Commerce (2024).
1.Service provider

2.Description of services
Bg Cars offers the following services in connection with the import of vehicles from the United States to Georgia:
- Information and consultation services on cost estimates and documentation.
- Brokerage services on Copart and IAAI auctions — bidding on your instructions.
- Organisation of logistics and shipping from the USA to the port of Batumi or Poti.
- Organisation of customs clearance in Georgia.
- Local delivery from Batumi to other cities in Georgia.
We act as an intermediary (broker). We are not the auction operator, the ocean carrier, or the customs authority. The actual services are provided by the relevant third parties under their own terms.
3.Price and pricing
- Prices published on the website are approximate estimates and do not constitute a binding offer.
- The final cost depends on the final auction price, auction fees, exchange rate, customs assessment, excise and other taxes, ocean shipping rates and additional fees.
- A specific offer is issued separately in writing (by email or Telegram) before any bid is placed.
- The website calculator is an informational tool and cannot be used as a binding financial commitment.
4.Payment
The website does not process online payments. Payments are made:
- Directly to the auction — to the auction account, under the auction's own terms.
- By bank transfer to a Georgian bank — based on an issued invoice.
- By cash or bank transfer — within the limits permitted by Georgian law.
We do not store your card or payment instrument data.
5.Binding nature of auction bids
A bid placed on an auction is legally binding under the rules of Copart and IAAI. Please note:
- Once placed, a bid cannot be cancelled.
- A won lot must be paid for within the period set by the auction (usually 1–3 working days).
- Late payment triggers auction penalties.
- Auction lots are sold on an "as-is" basis. Bg Cars is not liable for hidden defects.
6.Consumer right of withdrawal and refund
Under the Law of Georgia on Consumer Rights Protection (2022):
- For information / consultation services, you have the right to withdraw from the contract within 14 calendar days without giving a reason, provided that the service has not yet been fully performed.
- Once a bid is placed, the corresponding part of the service is deemed performed — the bid is not cancelled and the corresponding portion is not refunded.
- Amounts paid to the auction (lot price, auction fees, customs, shipping) are non-refundable as they are paid to third parties.
- Bg Cars consultation fees (if paid separately) are refunded within 14 days of receipt of the withdrawal request.

7.Client obligations
- Provide accurate and complete personal and contact information.
- Comply with the auction's and Bg Cars' bidding policy.
- Pay for the won lot, shipping and customs within the relevant deadlines.
- Refrain from misusing the website, loading it with automated scripts or attempting unauthorised access.
8.Limitation of liability
Bg Cars is not liable for:
- Hidden defects or inaccurate descriptions of auction lots (direct responsibility of the auction).
- Damage caused during ocean shipping (responsibility of the carrier and its insurance).
- Changes in customs assessment or legislation.
- Force majeure — war, natural disaster, epidemic, port strike, customs delays, international sanctions.
- Indirect, incidental or consequential damages.
Our total liability in any individual case shall not exceed the amount of the consultation/brokerage fee actually received by Bg Cars under the relevant transaction.
9.Intellectual property
All text, graphics, logos and code on the website are the property of Bg Cars or its licensors and are protected by Georgian and international law. Copying, distribution or commercial use without prior written consent is prohibited. Copart and IAAI logos and trademarks are the property of their respective owners.
10.Complaints and dispute resolution
Please submit any complaint or claim first directly to [email protected]. We aim to respond within 10 working days.
If we cannot reach a mutual resolution, you have the right to file a complaint with the Competition and Consumer Agency of Georgia:
Any dispute arising from these terms is governed by Georgian law and falls under the jurisdiction of Batumi City Court.
11.Governing law
These terms are governed by the law of Georgia. In particular, the Civil Code of Georgia, the Law on Consumer Rights Protection, the Law on Electronic Commerce, and the Law on Personal Data Protection apply.
12.Changes to these terms
We reserve the right to update these terms at any time. Changes take effect once published on the website. Offers already issued to a client remain governed by the version of the terms under which they were issued.
